Employers should set out clear rules and procedures for dealing with disciplinary issues. Having done so, these rules and procedures should be applied consistently and fairly.
The ACAS Code of Practice dealing with disciplinary and grievance procedures lays down the benchmark for employers, and unreasonable failure to comply with this can result in an Employment Tribunal award of compensation being increased by up to 25%.
