Mediation is a voluntary process where the parties, with the assistance of a mutually appointed mediator or mediators, try to reach agreement on the issues in dispute between them. In order to participate in this process both parties must be willing to attend sessions together. The mediator will try to help the parties resolve the issues in dispute but will not give legal advice. If an agreement is reached then a solicitor will be required to prepare a formal agreement. The benefit of mediation is that it allows the couple to control the decision making process and enables better lines of communication to be established following separation.
