Prenuptial Agreements

The cost of divorce cases in court can be very high and there is a large degree of discretion afforded to the court which means that the outcome can be uncertain. Prenuptial Agreements are therefore becoming increasingly popular in Scotland.

We will prepare an Agreement to suit your individual needs. Prenuptial Agreements are generally designed to limit or exclude the laws regulating the division of property on divorce. The boundaries about what constitutes matrimonial property can become hazy as a marriage goes on and a Prenuptial Agreement offers peace of mind and a degree of certainty about how your property would be divided on divorce.

Prenuptial Agreements have not yet been fully tested by the courts in Scotland. They are likely to be enforceable, however careful drafting is required to ensure enforceability.
