Employment Law Advent Calendar: Day 13

It’s the 13th of December and I can feel the Christmas spirt from my head to my mistletoes. Take a look behind door number 13 of my Employment Law Advent Celen-deer to see who or what is there with more employment law hints and tips.

It’s Scrooge

We don’t need reminded that 2021 has been another tough year and end of year planning may raise the possibility of redundancies. It’s never a good time to make someone redundant, but it is even harder at Christmas.

Here’s what employers need to know:

1 Be sure that it is a genuine redundancy situation and, if so, whether it is a collective redundancy.

2 The selection of employees should be approached using a fair system which does not discriminate against any individual or groups of employees.

3 Employees should be consulted with because it is fundamental to a fair redundancy process.

4 Redundancy payments should be correctly calculated and, in some circumstances, do not need to be paid.

Make sure you elf a merry little Christmas and contact a member of the Blackadders Employment Team working in Aberdeen, Dundee, Edinburgh, Glasgow, Perth and across Scotland for help and advice.
